This Privacy Policy explains how we collect, hold, use and disclose personal information in connection with our business, including through dapropertygladstone.com.

We are committed to handling personal information in accordance with the Privacy Act 1988 (Cth) and, where applicable, the Australian Privacy Principles (APPs). By dealing with us, using our website, making an enquiry or providing personal information to us, you acknowledge that your information may be handled as described in this policy.

  1. Scope of this policy

    This policy applies to personal information collected by DA Property in the course of providing real estate services and operating our business and website. It applies to sellers, buyers, prospective buyers, landlords, tenants, prospective tenants, suppliers, contractors, job applicants and other people who interact with us.

    Third-party websites, portals and services linked from our website or used in connection with a property transaction may have their own privacy policies. Their handling of personal information is governed by their own practices and policies.

  2. What personal information we collect

    The information we collect depends on your relationship with us and the service being provided. It may include:

    • information required for anti-money laundering and counter-terrorism financing compliance, including customer due diligence information; and

    • conducting appraisals, inspections, property marketing and buyer or tenant enquiries;

    • negotiating and administering property sales, offers and contracts;
    • communicating with clients, buyers, tenants, prospective parties, advisers and service providers;

  5. Property sales and property management

    For property sales, we may collect and use personal information to:

    • identify and verify sellers, buyers and relevant representatives;

    • prepare or assist with transaction documentation within the scope of our role;
    • liaise with sellers, buyers, solicitors, conveyancers, financiers, contractors and other parties involved in a transaction; and

    For leasing and property management, we may collect and use personal information to:

    • identify landlords, tenants and prospective tenants;

  6. AML/CTF compliance

    From 1 July 2026, anti-money laundering and counter-terrorism financing obligations apply to relevant real estate services in Australia. Where those obligations apply to a service we provide, we may collect, verify, use and disclose personal information as reasonably required to conduct customer due diligence and meet our obligations under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) and associated rules.

    This may include identity and beneficial ownership information and, where required, information concerning source of funds or source of wealth. Information may be disclosed to identity verification providers, AML/CTF service providers, professional advisers, other reporting entities or real estate professionals where permitted, and government authorities including AUSTRAC where required or authorised by law.

    If information required for customer due diligence is not provided or cannot be verified, we may be unable to provide some services.

  7. How we disclose personal information

    We may disclose personal information where reasonably necessary for the purposes described in this policy, including to:

    • property owners, sellers, buyers, tenants and prospective parties where appropriate;
    • solicitors, conveyancers, accountants, financiers, mortgage brokers and other professional advisers;
    • auctioneers, valuers, surveyors, body corporate or strata representatives, insurers and claims providers;
    • tradespeople, contractors, photographers and other property service providers;
    • property listing and marketing platforms, customer relationship management systems, property management systems and communications providers;
    • tenancy databases, referees and identity or application verification providers where relevant;
    • financial institutions and payment service providers;
    • government, regulatory and law enforcement bodies, including AUSTRAC, the Australian Taxation Office, Queensland tenancy and titles authorities, where required or authorised by law; and
    • IT, cloud, data, website, cybersecurity and other service providers that assist us to operate our business.

    We do not sell personal information. We do not disclose personal information for unrelated purposes unless you have consented or the disclosure is otherwise permitted or required by law.

  8. Overseas disclosure and cloud services

    Some technology, cloud, software, communications, marketing, identity verification or other service providers used by us may store, process or access information outside Australia. The countries involved may vary depending on the provider, its infrastructure and the service being used, and it may not always be practicable for us to identify every country in which information is processed or stored.

    Where the Privacy Act requires us to take steps in relation to an overseas disclosure, we will take reasonable steps appropriate to the circumstances to ensure the information is handled consistently with applicable privacy obligations.

    Where permitted by law, we may use your contact details to tell you about properties, market updates or services that may be relevant to you. You may opt out of direct marketing at any time by using an unsubscribe facility where provided or by contacting us. We will process opt-out requests as soon as reasonably practicable.

    If you provide personal information about another person, you should only do so where you are authorised to provide it. Where appropriate, you should make that person aware that their information has been provided to DA Property and direct them to this Privacy Policy.

  15. Accessing and correcting your personal information

    You may request access to personal information we hold about you or ask us to correct information that is inaccurate, out-of-date, incomplete, irrelevant or misleading. Please contact our Privacy Officer using the details below. We may need to verify your identity before responding. We will respond within a reasonable period and, where permitted by law, may charge a reasonable fee for providing access. If we refuse access or correction, we will provide reasons where required by law.

    If you believe we have not handled your personal information appropriately, please contact our Privacy Officer and provide details of your concern. We will acknowledge and investigate the complaint and aim to respond within a reasonable period.
